1. Who you're contracting with

The Glimmering Wings service ("Service") is operated by Northstart Systems LLC("we," "us," "our"). By accessing or using the Service you ("you," the "User") agree to these Terms. If you do not agree, do not use the Service.

2. Acceptance

Your continued use of the Service constitutes acceptance of these Terms and any updates. You must be at least the age of majority in your jurisdiction, or use the Service with the consent of a parent or guardian. The Service is intended for parents, guardians, and family members; children should only use it under adult supervision.

3. The Service

Glimmering Wings creates personalized digital keepsakes — Tooth Fairy letters, certificates, bedtime stories, and short AI-generated videos — based on information you provide about a child. Content is generated using third-party AI models and is delivered through your account.

4. Acceptable use

You agree NOT to:

• use the Service unlawfully or to infringe anyone's rights;
• submit content depicting a child you do not have authority to represent;
• attempt to bypass technical limits, scrape, probe, reverse-engineer, or distribute malware;
• resell, republish, or commercially redistribute generated keepsakes or videos;
• use outputs for harassment, hate speech, sexual content, deepfakes, or to mislead.

5. AI-generated content

Letters, stories, and videos are produced by generative AI models and may contain inaccuracies, unexpected wording, or imperfect imagery. You are responsible for reviewing outputs before sharing them with a child. We may filter, moderate, regenerate, or refuse outputs to keep the Service tasteful and safe. We grant you a personal, non-exclusive, non-transferable license to use the keepsakes you create for personal, non-commercial purposes.

6. Your content

You retain rights to information you submit (the child's name, photos, hobbies, etc.). You grant us a limited license to process that content only to operate and improve the Service. You confirm you have the right to provide that information. We will remove a child's data on request — see our Privacy Notice.

7. Intellectual property

We retain all rights in the Service, our software, branding, prompts, character designs (including "Luna" the fairy), and underlying assets. Nothing in these Terms transfers ownership of those rights to you.

8. Fairy Dust credits & purchases

Video generation is metered in "Fairy Dust" credits, sold in one-time packs. Credits are non-transferable, have no cash value, and do not expire while your account is active. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's Buyer Termsgovern payments, billing, tax, cancellations, and chargebacks.

10. Service availability

We provide the Service on an "as is" and "as available" basis without warranty of uninterrupted or error-free operation. AI providers, payment providers, and hosting providers may experience outages.

11. Suspension & termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may stop using the Service at any time. Upon termination, your keepsakes remain available for export for a reasonable period unless removed for cause.

12. Disclaimers & liability

To the fullest extent permitted by law, we disclaim all implied warranties (merchantability, fitness for a particular purpose, non-infringement). Our aggregate liability for any claim arising from the Service is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages. Nothing limits liability for fraud, gross negligence, or death/personal injury where prohibited by law.

13. Indemnity

You agree to indemnify and hold us harmless from claims arising out of content you submit or your misuse of the Service.

14. Changes

We may update these Terms by posting a revised version with a new effective date. Continued use after changes means you accept them.

15. Governing law

These Terms are governed by the laws of the United States and the state in which Northstart Systems LLC is registered, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts of that jurisdiction.
